Duncan Sales Wins Legal Battle with Audio Associates, Inc.

Following a lengthy legal battle, a New Jersey Superior Court jury returned a verdict in favor of Innergroove, LLC dba Duncan Sales on its claims of breach of contract and tortious interference against defendants Joseph Blacker and Audio Associates, Inc., a company operated by Mr. Blacker based in Columbia, Maryland. The parties had entered into an agreement for Duncan Sales to be the “exclusive retail representative” for Audio Associates in the New York Metro territory. The legal dispute arose when Audio Associates breached this Agreement after two years.
Based on the verdict, a judgment has been entered against Audio Associates for commissions owed to Duncan Sales that were unpaid at the time of the improper termination of the agreement. The judgment also awards post-termination commissions that would have been paid had the agreement not been ended by Audio Associates. Finally, the jury unanimously determined that Mr. Blacker, personally and improperly interfered with Duncan Sales’ prospective business in the New York metropolitan territory. This verdict resulted in a third monetary award.
The total damages and legal fees awarded to Duncan Sales from defendants’ conduct exceeds $200,000. In addition, the Superior Court dismissed all counterclaims brought by Audio Associates, determining them to be “unsupported and self-serving.”
